By accessing or using PetsWarehouse.com (the “Website”) and/or placing an order, you agree to be legally bound by these Terms and Conditions, as well as our Shipping and Returns Policy, Privacy Policy, and any additional terms referenced herein (collectively, the “Agreement”). If you do not agree, you may not use this Website or purchase products.

1. Incorporation of Shipping & Returns Policy
The Shipping & Returns Policy is expressly incorporated into and forms a material part of this Agreement. In the event of any conflict, the Shipping & Returns Policy shall govern matters relating to fulfillment, delivery, returns, refunds, and disputes.
2. Formation of Contract (Purchase Order)
Each order submitted constitutes an offer to purchase. Acceptance occurs only when the order is confirmed and processed. The order confirmation, these Terms, and all referenced policies collectively form the “Purchase Order,” which represents the entire agreement governing the transaction.
3. Eligibility and Payment Authorization
By placing an order, you represent and warrant that:
- You are at least 18 years of age
- You are the authorized holder of the payment method used
- All information provided is accurate and complete
All orders must be prepaid. We reserve the right to cancel or refuse any order at our sole discretion.
4. Pricing, Errors, and Availability
We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been submitted. Orders may be canceled if pricing or product information is incorrect.
Product availability is not guaranteed. Certain items may require additional processing time.
5. Shipping, Delivery, and Risk of Loss
All delivery dates are estimates and not guarantees. Pets Warehouse is not liable for delays caused by carriers or events beyond our control.
Title and risk of loss transfer to the customer upon delivery to the carrier.
Carrier-provided proof of delivery, including tracking confirmation, shall constitute conclusive proof that the order was delivered and fulfilled.
6. Returns, Refunds, and Order Issues
All returns, refunds, and order-related claims are governed exclusively by our Shipping & Returns Policy. Failure to comply with those terms, including required notification timeframes, shall result in denial of claims.
Unauthorized returns will not be accepted or processed.
7. Product Representation and Manufacturer Variations
Product images, descriptions, and specifications are provided for illustrative purposes only. Actual products may vary, including but not limited to packaging, labeling, colors, dimensions, and materials. Manufacturers may modify, substitute, or update products or packaging without prior notice.
Such variations shall not be considered defects, misrepresentation, or non-conformity, and do not constitute valid grounds for return, refund, replacement, or chargeback.
8. Manufacturer Warranties
All warranties are provided solely by the manufacturer, if applicable. Pets Warehouse makes no independent warranties, express or implied, and disclaims all implied warranties to the fullest extent permitted by law.
9. Limitation of Liability
To the fullest extent permitted by law, PetsWarehouse.com shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of the Website or purchase of products.
10. Chargebacks and Payment Disputes
By completing a purchase, you agree to contact Pets Warehouse to resolve any issue prior to initiating a chargeback or payment dispute.
You acknowledge that the following constitute valid grounds for dispute denial:
- Failure to follow the Shipping & Returns Policy
- Delivery confirmation by the carrier
- Product variations as disclosed
- Missed reporting deadlines
We reserve the right to provide all transaction records, delivery confirmation, customer communications, IP address logs, and policy acceptance records to financial institutions to contest disputes.
11. Cancellations and Modifications
Orders may only be canceled or modified prior to processing. Once submitted for fulfillment, cancellations may be denied or subject to fees as outlined in the Shipping & Returns Policy.
12. Fraud Prevention
We reserve the right to refuse, cancel, or limit any order suspected of fraud, unauthorized activity, or abuse of policies, including excessive returns or disputes.
13. Privacy
Use of the Website is subject to our Privacy Policy. By using our services, you consent to data collection and processing as described therein, including processing by third-party platforms such as Shopify.
14. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located within New York.
15. Entire Agreement
This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements. Any waiver must be in writing and signed by an authorized representative of Pets Warehouse.
